Terms and Conditions
These Terms and Conditions ("Terms") govern your use of www.jbwineservices.com and your interaction with JB Wine Services ("JBWS," "we," "us," or "our"). They also establish general conditions for inquiries, proposals, bookings, wine-education services, tasting experiences, corporate events, pairings, and cellar-related consulting.
A signed proposal, booking confirmation, event agreement, statement of work, invoice, or third-party booking-platform agreement may include additional or different terms. If there is a conflict, the document specific to the booked service controls for that service.
1. Acceptance of Terms
By accessing the website, submitting an inquiry, requesting a proposal, booking a service, or participating in a JBWS event, you agree to these Terms. If you do not agree, do not use the website or book or participate in the services.
2. Eligibility and Legal Drinking Age
You must be at least 18 years old to enter into a contract with JBWS and at least 21 years old to purchase, possess, receive, be served, or consume alcoholic beverages in connection with a JBWS experience. JBWS, the host, venue, or licensed provider may require valid government-issued photo identification and may refuse participation or alcohol service when age, identity, sobriety, safety, or legal compliance cannot be confirmed.
3. JBWS Services
JBWS provides educational, experiential, advisory, and event-related services, which may include private wine tastings, corporate events, guided pairings, blind tastings, wine education, cellar consulting, and customized experiences. The exact scope, date, location, guest count, responsibilities, deliverables, and fees will be stated in the applicable proposal or booking confirmation.
Wine evaluation and recommendations are subjective and may depend on personal preference, availability, vintage variation, storage conditions, market pricing, and other factors. JBWS does not guarantee that a particular wine, vintage, producer, venue, or third-party product will remain available.
4. Alcohol Purchasing, Sales, Service, and Licensing
Unless a written event agreement expressly states otherwise and all required licenses and permissions are in place, JBWS provides education, curation, facilitation, and consulting services and does not sell alcoholic beverages. The client or host is responsible for purchasing alcoholic beverages from lawful sources and for confirming that the venue, event structure, alcohol possession, service, and consumption comply with applicable law.
When a licensed venue, caterer, winery, retailer, booking platform, or other third party supplies or serves alcohol, that party is responsible for its own licensing, sales, service, staffing, and legal compliance. JBWS may coordinate with such providers but does not assume their legal duties.
5. Booking and Confirmation
An inquiry or proposal request does not reserve a date. A booking is confirmed only after JBWS issues written confirmation and receives any required signed agreement, deposit, platform confirmation, or other payment stated in the proposal. JBWS may decline a booking that presents legal, safety, venue, timing, staffing, or operational concerns.
The client must provide accurate information about the event, including the date, location, guest count, age profile, venue rules, access requirements, service expectations, and any known conditions that may affect safe or lawful performance.
6. Fees, Deposits, Payments, and Taxes
Fees, deposits, payment schedules, reimbursable expenses, travel charges, taxes, and payment methods will be stated in the applicable proposal, invoice, booking confirmation, or third-party platform. Unless the service-specific terms state otherwise, deposits are applied to the booked service and are nonrefundable because JBWS reserves the date and begins planning and preparation.
Past-due amounts may result in suspension or cancellation of services. The client is responsible for reasonable costs incurred to collect undisputed past-due amounts, to the extent permitted by law.
7. Changes, Cancellations, and Rescheduling
The cancellation, refund, and rescheduling terms stated in the proposal, booking confirmation, invoice, or third-party platform control. When the service-specific terms are silent, any deposit remains nonrefundable, and JBWS may, in its discretion and subject to availability, apply amounts paid to one rescheduled event requested with reasonable advance notice.
Changes to date, time, location, guest count, scope, theme, wine selection, food pairing, or venue requirements may affect pricing and availability. JBWS may issue a revised proposal or change order. Failure to obtain necessary venue approval, permits, insurance, or alcohol-related permissions is treated as a client cancellation unless otherwise agreed in writing.
8. Client and Host Responsibilities
Unless the service-specific agreement assigns a responsibility to JBWS, the client or host is responsible for:
- Providing a safe, lawful, accessible, and suitable event location.
- Obtaining venue approvals, permissions, permits, licenses, and insurance required for the event.
- Ensuring that all alcohol is purchased, transported, stored, opened, served, and consumed lawfully.
- Ensuring that no person under 21 receives or consumes alcohol.
- Communicating event rules and safety expectations to guests.
- Providing accurate guest counts and timely access for setup and performance.
- Supplying agreed venue items such as tables, chairs, glassware, water, ice, refrigeration, disposal facilities, and cleanup support.
- Arranging safe transportation and preventing an impaired guest from driving.
- Protecting the venue and property from damage caused by the client, guests, or third-party providers.
9. Responsible Consumption and Guest Conduct
Participation in alcohol tasting involves inherent risks, including intoxication, impaired judgment, allergic or adverse reactions, falls, accidents, and interactions with medications or health conditions. Guests are responsible for their own consumption decisions and should not consume alcohol when prohibited by law, medical guidance, medication instructions, pregnancy-related guidance, or personal circumstances.
JBWS may refuse or stop alcohol service, remove a participant from an activity, pause an event, or end services when JBWS reasonably believes a person is underage, intoxicated, disruptive, threatening, unsafe, or acting unlawfully. No refund is required when service is refused or ended due to a participant’s conduct or the client’s failure to maintain a safe and lawful environment.
10. Food, Allergies, and Dietary Restrictions
Wine experiences may include or recommend food, cheese, chocolate, shellfish, nuts, gluten, dairy, or other common allergens. Clients and guests must disclose relevant allergies or dietary restrictions in advance. JBWS cannot guarantee an allergen-free environment or prevent cross-contact, particularly when food is prepared, supplied, or served by third parties. Guests with severe allergies should assess the risk and make appropriate personal arrangements.
11. Third-Party Products, Venues, and Platforms
JBWS may recommend or coordinate with wineries, wine retailers, venues, caterers, transportation providers, booking platforms, payment processors, or other third parties. Those parties are independent and responsible for their own products, services, representations, availability, terms, privacy practices, licensing, and conduct.
When you book through a third-party platform, that platform’s payment, cancellation, refund, dispute, and privacy terms also apply and may control the platform transaction.
12. Website Use
You may use the website only for lawful, personal, or legitimate business purposes. You may not:
- Interfere with the website’s security, operation, or availability.
- Attempt unauthorized access to systems, accounts, or data.
- Use automated tools to scrape, copy, or extract content without written permission.
- Misrepresent your identity, age, authority, or affiliation.
- Submit unlawful, defamatory, infringing, fraudulent, or harmful content.
- Use JBWS content, branding, or materials to imply endorsement or affiliation without permission.
13. Intellectual Property
The website and JBWS-created content, including text, graphics, logos, photographs, tasting frameworks, educational materials, event concepts, handouts, and presentation materials, are owned by or licensed to JBWS and are protected by applicable intellectual-property laws. JBWS grants you a limited, revocable, nonexclusive right to use the website and any client materials for personal, noncommercial use connected to the purchased service. You may not reproduce, publish, sell, distribute, modify, or create derivative works from JBWS materials without written permission.
14. Reviews, Testimonials, Photos, and User Content
If you submit a review, testimonial, photograph, or other content to JBWS, you represent that you have the right to provide it and that it is accurate and lawful. JBWS will not use an identifiable guest’s image or testimonial for public marketing without permission or another lawful basis. Any agreed use may be subject to separate written consent or platform terms.
15. Educational Disclaimer and No Professional Advice
JBWS content and services are provided for education, entertainment, and general informational purposes. They are not medical, legal, tax, investment, insurance, nutritional, or other regulated professional advice. Cellar and purchasing recommendations are not guarantees of value, appreciation, resale potential, provenance, storage performance, or market availability.
16. Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided on an ’as available’ and ’as is’ basis. JBWS disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, and any warranty arising from course of dealing or usage of trade. JBWS does not warrant that the website will be uninterrupted, error-free, or completely secure, or that any wine, pairing, recommendation, or event will satisfy every participant’s preferences.
17. Limitation of Liability
To the fullest extent permitted by law, JBWS will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost opportunity, reputational harm, or loss of data, arising from the website, services, event participation, third-party products, venue conditions, guest conduct, or alcohol consumption.
To the fullest extent permitted by law, JBWS’s total aggregate liability arising from a particular booked service will not exceed the amount actually paid to JBWS for that service. This limitation does not exclude liability that cannot legally be limited or waived.
18. Indemnification
To the fullest extent permitted by law, the client agrees to defend, indemnify, and hold harmless JBWS and its owner, contractors, and representatives from third-party claims, losses, liabilities, damages, and reasonable costs arising from the client’s breach of these Terms, inaccurate event information, unlawful alcohol purchase or service, venue conditions, guest conduct, client-provided products, or failure to obtain required permissions, except to the extent caused by JBWS’s gross negligence or willful misconduct.
19. Force Majeure
JBWS is not liable for delay, modification, relocation, substitution, or nonperformance caused by circumstances beyond reasonable control, including severe weather, natural disaster, wildfire, public-health event, government order, labor disruption, utility or technology failure, transportation interruption, venue closure, supply shortage, illness, emergency, or acts of third parties. JBWS will make reasonable efforts to communicate and identify a practical alternative, but refunds or credits remain subject to the service-specific agreement.
20. Privacy
JBWS’s collection and use of personal information are described in the JBWS Privacy Policy, which is incorporated into these Terms by reference.
21. Governing Law and Dispute Resolution
These Terms and any dispute involving JBWS are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Before filing a legal claim, the parties agree to make a good-faith effort to resolve the matter through direct written notice and reasonable discussion. Unless applicable law requires otherwise, any court proceeding must be brought in a state or federal court located in Maricopa County, Arizona, and each party consents to that jurisdiction and venue.
22. Changes to These Terms
JBWS may update these Terms to reflect changes in law, services, technology, or business practices. Updated Terms will be posted with a revised ’Last Updated’ date. Changes apply prospectively unless otherwise required by law. The terms in effect when a service is booked will generally govern that booking unless the parties agree otherwise.
23. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect, and the invalid provision will be enforced to the maximum extent permitted. JBWS’s failure to enforce a provision is not a waiver. You may not assign your rights or obligations without JBWS’s written consent. These Terms, together with the Privacy Policy and any service-specific agreement, constitute the entire agreement concerning the subject matter they cover.
